Federal Judge Orders Freedom of Abrego Garcia from ICE Detention

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks lawful basis.

"Since his return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.

The case stems from a erroneous removal to El Salvador earlier this year, which the government later admitted was an error. Following his repatriation to the United States to answer alien smuggling charges, he was detained in immigration detention.

In her decision, the judge pointed out that the government lacks a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
